Comunicato del Consiglio dei Ministri
Il Consiglio dei Ministri si è riunito Martedì ad Algeri sotto la presidenza del Presidente della Repubblica, Abdelaziz Bouteflika, e ha pubblicato il seguente comunicato :
“Sua Eccellenza il Presidente Abdelaziz Bouteflika, Presidente della Repubblica, ha presieduto oggi, martedì 5 giugno 2018, corrispondente al 20 Ramadhan 1439, una riunione del Consiglio dei Ministri.
Il Consiglio dei Ministri ha iniziato i lavori esaminando e adottando un progetto di legge organica che stabilisce le condizioni e le procedure per l’applicazione dell’eccezione di incostituzionalità, testo presentato dal Guardasigilli e Ministro della giustizia.
L’eccezione di incostituzionalità è un progresso giuridico recente introdotto dall’articolo 188 della Costituzione. Il disegno di legge organica viene per codificarne l’applicazione.
Pertanto, il Consiglio costituzionale può ricevere delle richieste per eccezione di incostituzionalità, su richiesta della Corte Suprema o del Consiglio di Stato, quando una delle parti in causa, sostiene dinanzi al giudice che la disposizione legislativa da cui dipende l’esito della controversia viola i diritti e le libertà garantiti dalla Costituzione.
Il ricorso all’eccezione di incostituzionalità a livello di un tribunale è sospensivo, tranne quando si tratta di decidere sulla cessazione della detenzione o in caso di emergenza. Quando il Consiglio Costituzionale accoglie un ricorso per eccezione di incostituzionalità, la disposizione legislativa che ha costituito oggetto del ricorso decade.
Intervenendo a seguito dell’adozione di detto disegno di legge, il Presidente della Repubblica ha espresso soddisfazione per i nuovi progressi compiuti nella riforma della giustizia e nella modernizzazione del diritto, una riforma che ha già prodotto molti effetti a beneficio delle parti in causa, e che pone il nostro paese tra gli Stati più avanzati in questo campo. Allo stesso tempo, il Capo dello Stato ha invitato a proseguire ed a approfondire questa riforma, perché l’aggiornamento delle nostre leggi e la modernizzazione del nostro sistema giudiziario costituiscono un processo permanente per accompagnare la riforma di qualsiasi governance nel paese.
Il Consiglio dei Ministri ha proseguito i lavori esaminando e adottando la bozza di legge organica relativa all’Accademia algerina della lingua Amazigh presentata dal Ministro dell’Educazione Superiore e della Ricerca Scientifica.
L’articolo 4 della Costituzione, in particolare, ha creato l’Accademia algerino della lingua Amazigh, collocata presso il Presidente della Repubblica e il progetto di legge organica definisce i compiti, la composizione, l’organizzazione e il funzionamento di questo organo.
In particolare, L’Accademia sarà incaricata di raccogliere il contesto nazionale della lingua amazigh in tutte le sue varietà linguistiche, stabilire la standardizzazione della lingua amazigh a tutti i livelli di descrizione e di analisi linguistica, e di sviluppare un dizionario di riferimento dellla lingua Amazigh.
La composizione dell’Accademia è composta da non più di 50 membri, scelti tra esperti e competenze comprovate nel campo delle scienze del linguaggio e in relazione alla lingua Amazigh e alle scienze correlate.
L’Accademia avrà un Consiglio, un Presidente, un Ufficio e delle Commissioni specializzate.
Accogliendo con favore la presentazione del disegno di legge nei tempi previsti, il presidente Abdelaziz Bouteflika ha dichiarato che l’adozione di questo testo da parte del Parlamento incoronerà il processo di riappropriazione del tamazight da tutta l’Algeria come uno dei fattori di consolidamento dell’unità del suo popolo.
“La lingua nazionale e ufficiale, Tamazight, che lo Stato promuoverà come previsto dalla Costituzione, ha oramai bisogno dell’apporto di competenze nazionali in questo settore, per sviluppare, all’interno dell’Accademia, strumenti e regole per aumentare l’uso e la diffusione di questa lingua, una parte inseparabile della nostra identità nazionale “, ha aggiunto il Presidente della Repubblica.
Il Consiglio dei ministri ha inoltre esaminato e adottato un disegno di legge finanziaria aggiuntiva per l’anno 2018, presentato dal Ministro delle finanze.
Nella sua sezione di bilancio, il disegno di legge si limita all’aggiunta di un importo di 500 miliardi di DA in autorizzazioni di programmi, senza l’inclusione di crediti di pagamento aggiuntivi.
Questo nuovo stanziamento permetterà di rilanciare una serie di progetti, tra cui quelli sociali, congelati negli ultimi anni a causa della pressione finanziaria sul bilancio dello Stato. Esso permetterà inoltre di avviare nuovi progetti infrastrutturali che saranno finanziati attraverso l’assistenza temporanea del Fondo nazionale per gli investimenti. Queste includeranno ferrovie e tangenziali da costruire o da modernizzare per il nuovo centro portuale, e l’aumento dello sfruttamento delle miniere di fosfati e la modernizzazione del porto di Annaba in relazione a questo obiettivo.
Nella sua parte legislativa, il disegno di legge finanziaria aggiuntiva prevede, tra l’altro, l’introduzione di un’imposta supplementare provvisoria di salvaguardia nel settore del commercio estero.
Durante l’esame di questo disegno di legge, e in materia di aumento delle tasse su determinati documenti amministrativi, il Presidente della Repubblica ha deciso la cancellazione di tutte le proposte di aumento delle tasse per i documenti amministrativi.
Commentando in seguito questo disegno di legge dopo la sua adozione, il Presidente ha sottolineato che se il governo deve mantenere una gestione prudente delle risorse finanziarie del Paese, questo non dovrebbe impedire la ripresa dei progetti sociali congelati negli ultimi anni e il consolidamento della rete infrastrutturale di base, soprattutto quando esse sono collegate a progetti economici la cui redditività è determinata.
Inoltre, il Presidente Abdelaziz Bouteflika ha invitato gli operatori a trarre vantaggio del processo di backup temporaneo che il Paese ha istituito nel commercio con l’estero per aumentare i loro investimenti e aumentare la produzione di beni e servizi per soddisfare le domanda locale e diversificare le esportazioni del Paese.
Inoltre, il Consiglio dei Ministri ha esaminato e adottato tre decreti presidenziali recanti approvazioni di un contratto e di due modifiche ai contratti relativi all’esplorazione e allo sfruttamento di idrocarburi, in particolare:
- Un contratto per lo sfruttamento di idrocarburi sul perimetro chiamato “Timimoun Blocs 325a e 329”, concluso tra l’Agenzia ALNAFT e il consorzio comprendente Sonatrach, Cepsa Algérie e Total Algerie.
- Un emendamento al contratto tra Sonatrach e la società spagnola CEPSA per la ricerca e lo sfruttamento di perimetro “Rhoude Yacoub, bloc 406a” al fine di prorogare fino a 36 mesi l’esplorazione del perimetro.
- Una modifica del contratto concluso tra ALNAFT e SONATRACH ed i suoi suoi partner “Dragon Oil” ed “Enel”. L’emendamento si riferisce ad una carica totale di trasferimento a titolo gratuito da “Enel” a “Dragon Oil” dei suoi diritti sul perimetro “Tinhert Nord blocs 235B, 244b, 223b’, Sonatrach mantenendo sempre una maggioranza del 51%.
Il Consiglio dei Ministri ha successivamente ascoltato una comunicazione del Ministro dei Lavori Pubblici e dei Trasporti in merito alla rivalutazione delle operazioni di equipaggiamento.
Queste operazioni, che sono in fase avanzata di attuazione, si riferiscono rispettivamente alla duplicazione e la rettifica della ferrovia tra El Khemis et el Affroun e anche tra Oued Sly e Yellel, circoncallazione stradale della città di Cherchell, la valorizzazione del porto di Djendjen, la realizzazione di un nuovo modulo all’aeroporto di Oran Essenia e il Tramway di Ouargla.
Il Consiglio dei Ministri ha anche ascoltato e discusso una comunicazione del Ministro dell’interno, delle Collettività locali e della Pianificazione territoriale sugli accordi presi per il mese di Ramadhan 1439.
Così,riguardo alle operazioni di solidarietà nazionale, 8,4 miliardi di dinari sono stati mobilitati in particolare da parte dei Comuni e delle wilaya, per garantire la distribuzione di quasi 2 milioni di panieri, e la distribuzione di quasi sei milioni di pasti caldi a livello di 1.300 ristoranti.
Per quanto riguarda le condizioni di vita della popolazione, la mobilisazione di oltre 30 miliardi di DA supplementari per il settore, garantirà la continua disponibilità di acqua potatile in tutto il Paese, comprese le 600 città che hanno registrato un deficit. Per quanto riguarda la fornitura continua di energia elettrica, sarà garantita anche grazie alla messa in servizio di nuove capacità di produzione.
Da parte loro, i servizi di La Poste, in collaborazione con la Banca algerina, hanno provveduto a garantire la disponibilità di contanti a livello di ufficio postale.
L’approviggionamento del mercato di cibo è stato preparato inanzitutto in relazione con la stagione del raccolto di orticoltura, e delle le scorte di cereali e latte in polvere detenuti dagli uffici pubblici competenti, mentre la disponibilità di carne è assicurata dalle importazioni.
Infine, in collaborazione con le autorità locali, i servizi commerciali hanno organizzato numerosi mercati locali, che hanno iniziato il loro intervento prima dell’inizio del mese sacro, mentre i controlli sui prezzi e sulla qualità sono stati rafforzati.
Parlando dopo il dibattito su questo tema, il Presidente della Repubblica ha incaricato i servizi interessati di assicurare la realizzazione di tutte queste misure durante il mese di Ramadhan e oltre.
